The Respondent in paragraph 7 of the counter-affidavit filed on 18-5-16 informed the Court that the 3rd Respondent on record Vitalis Ugweme was never a party to the dispute. He is correct. Vitalis Okwu is not set out in the notice of appeal. If the 3rd Appellant has never been a party to the dispute, he has not business in the notice of appeal and ought to be struck. The name of the 3rd Appellant is hereby struck out from the notice of appeal filed on 23-2-12. Appeal set down for hearing 27-10-16.
