Section 616 CAMA 2020

Section 616 Companies and Allied Matters Act is about Delegation to liquidator of certain powers of Court. It is under Chapter 21 (Winding-up by the court jurisdiction) of the Act.

(1) Provision may be made by rules for enabling or requiring all or any of the powers and duties conferred and imposed on the Court by this Act, in respect of the matters following, to be exercised or performed by the liquidator as an officer of the Court, and subject to the control of the Court,that is to say, the powers and duties of the Court in respect of—

(a) holding and conducting of meetings to ascertain the wishes of creditors and contributories ;

(b) settling of lists of contributories and the rectifying of the register of members where required, and the collecting and applying of the assets ;

(c) requiring delivery of property or documents to the liquidator ;

(d) making of calls ; and

(2) Nothing in this section shall authorise the liquidator, without the special leave of the Court, to rectify the register of members, or, without either thespecial leave of the Court or the sanction of the Committee of Inspection, to make any call.
