Section 36 Electricity Act 2023
Section 36 of the Electricity Act 2023 is about Terms of office and conditions of service of Commissioners. It is under Part V (Establishment, Functions and Powers of the Nigerian Electricity Regulatory Commission) of the Act.
(1) Subject to the provisions of this section, a Commissioner shall hold office for a term of five years provided that to ensure continuity in the Commission, the term of appointment of the first seven Commissioners shall be as follows —
(a) the Chairman shall be appointed for five years; and
(b) the Vice Chairmen and other Commissioners shall be appointed for four
years.
(2) A Commissioner shall sot continue in office after the expiry of his term.
(3) Subject to section 37, a Commissioner shall hold office on such terms and conditions
as the President may fix in relation to Commissioners generally.
(4) A Commissioner whose term of office has expired is eligible for reappointment for
another term and no more.
(5) All appointments or re-appointments of Commissioners shall be made before expiry of their term of office in accordance with section 36 of this Act.
