Section 94 Electricity Act 2023

Section 94 of the Electricity Act 2023 is about Pension matters. It is under Part VIII (Establishment of the National Hydroelectric Power Producing Areas Development Commission) of the Act.

(1) Service in the Commission shall be permanent and pensionable for the purpose of the Pension Reform Act and persons employed in the N-HYPPADEC shall be entitled to such pensions, gratuities and other retirement benefits as are prescribed in that Act.

(2) Nothing in this Act shall prevent the appointment of a person to any office on terms which preclude the grant of pension and gratuity as in respect of that office.

(3) For the purpose of the application or the provision for the Pensions Reform Act, any power exercised by the Minister or other authority of the Government of the Federation other than the power to make regulations is vested in and shall be exercisable by the N-H YPPADEC and not by any other person or authority.
