Section 178 Electricity Act 2023

Section 178 of the Electricity Act 2023 is about Service to be subject to the Pension Reform Act. It is under Part XVIII (Nigerian Electricity Management Services Agency) of the Act.

(1) Service in the NEMSA shall be approved service for the purpose of the Pensions Reform Act, officers and other persons employed in the NEMSA shall be entitled to pensions, gratuities and other benefits as sre prescribed under it.

(2) Notwithstanding subsection (1), the NEMSA may appoint a person to any office on terms, which preclude the grant of a pension, gratuity or other retirement benefits in respect of that office.

(3) For the purpose of the application of the provisions of the Pensions Reform Act, any power exercisable by a Minister or other agency of the Government of the Federation, other than the power to make regulations under section 13 is vested in and shall be exercisable by the agency and not by any other person or agency.
