Section 219 Electricity Act 2023
Section 219 of the Electricity Act 2023 is about Unlawful use of information by inspector. It is under Part XX (Offences and Penalties) of the Act.
(1) If an electrical inspector, a police officer, an employee of NEMSA acquires, in the course of his duties, information relating to the financial affairs of any person, or to any commercial secret, or if any other person indirectly acquires such information from an electrical inspector, a police officer, or an employee of NEMSA, he shall not for personal gain make use of such information, nor disclose it to any other person except —
(a) mandatory disclosure required for performance of his position;
(b) for the purpose of legal proceedings under this Act or any other law; and
(c) to the extent that :t may be necessary to do so for the purpose of this Act or any other law.
(2) A person who uses information obtained in the circumstances described under subsection (1) and uses such information for his personal gain and contrary to the provisions of subsection (1) (a)-(c), commits an offence and is liable on conviction to the forfeiture of any proceeds accruing to him on account of the contravention of this section and a fine not more than N500,000 or imprisonment for a term not more than two years or both.
