Section 49 Federal Competition and Consumer Protection Act 2018
Section 49 of the Federal Competition and Consumer Protection Act 2018 is about Disclosure of interest by members of a panel. It is under Part VII (The Competition and Consumer Protection Tribunal) of the Act.
(1) A member of the Tribunal is not entitled to sit on a Panel if, during the hearing, it appears to the Tribunal that the matter concerns a financial or other interest of that member.
(2) A member affected by the provision of subsection (1) shall –
(a) immediately and fully disclose the fact and nature of the interest to the Chairman and to the presiding member at that hearing; and
(b) withdraw from any further involvement in that hearing.
