Section 52 Federal Competition and Consumer Protection Act 2018

Section 52 of the Federal Competition and Consumer Protection Act 2018 is about Powers of the Tribunal to order sale of assets. It is under Part VII (The Competition and Consumer Protection Tribunal) of the Act.

(1) The Tribunal may make an order directing any undertaking to sell any portion or all of its shares, interest or assets if the practice prohibited under this Act –
(a) cannot adequately be remedied under any other provision of this Act; or

(b) is substantially a repeat by that undertaking of conduct previously found by the Tribunal to be a prohibited practice.

(2) An order made under subsection (1) may provide for time-frame for compliance and any other term that the Tribunal considers appropriate, having regard to the commercial interests of the parties concerned.
