Texas Administrative Code Title 1 Section 5.202

1 Texas Administrative Code § 5.202 – Definitions

In this subchapter:

(1) “Administrative records regarding a proposed rule” means any nonprivileged and nonconfidential documents, communications, or other information created, received, or consulted by a state agency that are material to the development of the proposed rule. The term includes all information and comments that the state agency received from the public regarding the proposed rule.

(2) “Affects market competition” means:
(A) creates a barrier to market participation in this state; or
(B) results in higher prices or reduced competition for a product or service provided by or to a license holder in this state.

(3) “Division” means the Regulatory Compliance Division of the Office of the Governor established in Subchapter C, Chapter 57 of the Texas Occupations Code.

(4) “State agency” means a state agency listed in § 5.201(a) of this subchapter.
