Facts

The plaintiff sued the defendant in the native tribunal and on issues of fact was unsuccessful. He appealed to the Court of the Chief Commissioner, again on issues of fact, and was successful. His opponent appealed to the Appeal Court.

Held

(Kingdon, C.J., dissenting), on the issues of fact the native tribunal was plainly wrong, judgment of Chief Commissioner affirmed, and appeal dismissed.


The appeal is dismissed.
