S. SOWEMIMO, J.S.C. (Delivering the Leading Judgment): There is no merit in all the arguments addressed to the court. I do not intend to call on the  counsel for prosecution. Appeal is hereby dismissed.

C. IDIGBE, J.S.C.: I agree that there is no merit whatsoever in this appeal. The learned trial Judge adequately considered the facts in this case and the defence of provocation which he quite rightly rejected. This was a brutal case of murder and their Lordships of the Court of Appeal quite rightly rejected the appellant’s appeal. My Lords, I too would dismiss this appeal and it is hereby dismissed.

A. NNAMANI, J.S.C.: After hearing learned counsel for the appellant, and having read the records, I am convinced that there is no substance whatsoever in this appeal. The only defence in law which would have availed the appellant was provocation, but on the evidence before the trial Judge this was not open to him. This was cold blooded murder. I also agree that this appeal should be dismissed and it is hereby dismissed.
