We see no substance in this appeal. We think the learned trial Judge was entitled on the evidence before him to come to the conclusion that the plaintiff failed to prove publication of the libel complained of. The admission that the Daily Times was printed and published did not of itself establish publication. The appeal is accordingly dismissed with 37 guineas costs to respondents.
