The record of appeal was transmitted to this Court on 7th March 2014. On 7th July 2014 the Appellant filed his brief of argument and also filed on application seeking to regularize the said brief. On 14-10-14 Appellant through counsel withdrew his said application and same was struck out. Ever since then Appellant has taken no other steps in this appeal. The Respondent filed this motion on 1-3-16. It was served on Appellant?s counsel on 10-3-2016. They did not react to this application. This is a proper case in which the Respondent should be allowed his prayer. This appeal is dismissed pursuant to Order 18 Rule 10(1) of the Court of Appeal Rules 2011.
