JUDGMENT OF THE LORDS OF THE JUDICIAL COMMITTEE OF THE PRIVY COUNCIL, DELIVERED THE 10TH JULY, 1945.

Their Lordships have heard this case on behalf of the Appellant at considerable length, and the result has been to put it beyond doubt that the Appellant has been seeking to have three concurrent judgments on that which is a pure question of fact reviewed by this Board, which is contrary to the well-known practice of this Board, thece being in this case no special reason for departing from the usual practice; accordingly their Lordships will humbly advise His Majesty that this appeal should be dismissed.


The Appellant will pay the respondent’s costs of this appeal.
