Rule 3009 Federal Rules of Bankruptcy Procedure

Rule 3009 of the Federal Rules of Bankruptcy Procedure is about Chapter 7—Paying Dividends. It is under Part III (Claims and Distribution to Creditors and Equity Interest Holders; Plans) of the Rules.

In a Chapter 7 case, dividends to creditors on claims that have been allowed must be paid as soon as practicable. A dividend check must be made payable to and mailed to the creditor. But if a power of attorney authorizing another entity to receive payment has been filed under

Rule 9010, the check must be:

(a) made payable to both the creditor and the other entity; and

(b) mailed to the other entity.
