Section 101 Federal Competition and Consumer Protection Act 2018

Section 101 of the Federal Competition and Consumer Protection Act 2018 is about Power to hear persons in merger proceedings. It is under Part XII (Price Mergers) of the Act.

(1) In making a determination in respect of a merger notification, the Commission may hear any person, other than parties to the merger, who, in the opinion of the Commission, is able to assist in making a determination or the merger notification.

(2) Before making a determination in relation to a merger or a proposed merger, the Commission may decide to hold a hearing publicly or in private and shall appoint a date, time and place for holding the hearing and give notice of the date, time, and place so appointed and of the matters to be considered at the hearing to the persons entitled to be present at the hearing.
