Section 130 Evidence Act 2011
Section 130 Evidence Act 2011 is titled ‘Application of this Part‘. It is under Part VIII (EXCLUSION OF ORAL BY DOCUMENTAHV EVIDENCE) of the Act. It states as follows:
(1) Sections 128 and 129 apply only to parties to documents, and their representatives in interest, and only to cases in which some civil right or civil liability is dependent upon the terms of a document in question.
(2) Any person other than a party to a document or his representative in interest may, notwithstanding the existence of any document, prove any fact which he is otherwise entitled to prove.
(3) Any party to any document or any representative in interest of any such party may prove any such fact for any purpose other than that of varying or altering any right or liability depending upon the terms of the document.
(4) Nothing contained in this Part shall be taken to affect any of the provisions of any enactment as to the construction of wills.
