Section 161 Electricity Act 2023

Section 161 of the Electricity Act 2023 is about Limitation of suits against the Agency. It is under Part XVI (Rural Electrification Agency) of the Act.

(1) The provisions of the Public Officers Protection Act shall apply in relation to any suit instituted against any officer or employee of the Agency.

(2) No suit shall be commenced against the Agency, a member of the Board, officer or employee of the Agency before the expiration of a period of 30 days after a written notice of intention to institute a suit has been served on the Agency by an aggrieved party or his counsel.

(3) The notice referred to in subsection (2) shall state the —
(a) cause of action;
(b) particulars of the claims:
(c) particulars of the aggrieved party; and
(d) relief which he claims.
