Section 174 Electricity Act 2023

Section 174 of the Electricity Act 2023 is about Tenure of office. It is under Part XVIII (Nigerian Electricity Management Services Agency) of the Act.

(1) A member of the Governing Board appointed otherwise than by virtue of his office shall hold such office for a term of three years and may be eligible for re- appointment for only one further term of three years, which shall be on a part time basis.

(2) The office of a member of the Governing Board shall become vacant if —
(a) he resigns as a member o¢ the Governing Board by notice in writing under his hand addressed to the Minister: or
(b) the Minister is satisfied that it is not in the interest of the Governing Board for the member to continue in office and, upon the approval of the President, notifies the member in writing to that effect.

(3) The supplementary provisions as set out in the Fourth Schedule to this Act shall have effect to the proceedings of the Governing Board and other matters contained in it.
