Section 185 Child’s Right Act
Section 185 Child’s Right Act 2003 is about Miscellaneous. It is under Part XV (State Government Support for Children and Families) of the Act.
(1) Nothing in this Part of this Act shall affect any duty imposed on a State Government by or under any other enactment not inconsistent with this Act.
(2) Any question arising under sections 178 (2), 119 (2) or 188 (6) to (8) of this Act as to the ordinary residence of a child shall be determined by agreement between the State Governments concerned or, in default of agreement, by the Minister.
(3) Where the functions conferred on a State Government by this Part of this Act and the functions of an education authority are concurrent, the Minister may by regulations specify which of them is to perform the functions.
(4) The Minister may make regulation for determining, as respect any education authority functions specified in the regulations, whether a child who is being looked after by a State Government is to be treated, for, purposes so specified, as a child of parents of sufficient resources or as a child of parents without resources.
