Section 209 Electricity Act 2023
Section 209 of the Electricity Act 2023 is about Theft of electric lines anc materials. It is under Part XX (Offences and Penalties) of the Act.
(1) A person who —
(a) cuts, removes takes away transfers any electric line, material or meter from a tower, pole, any other installation or place of installation or any other place, or site where it may be rightfully or lawfully stored, deposited, kept,
stocked, situated or located including during transportation, without the consent of the licensee or its owner, as the case may be, whether or not the act is done for profit or gain,
(b) stores, possesses or otherwise keeps in his, hers or its premises, custody or control, any electric line, material or meter without the consent of the licensee or its owner, whether or not the act is committed for profit or
gain, or
(c) loads, carries, or moves from one ¢lace to another any electric line, material or meter without the consent of the licensee or its owner, whether or not the act is done for profit or gain, commits an offence of stealing of electric lines and materials and is liable on conviction to a fine of at least N500,000 or imprisonment for a term of at least three years and a maximum of up to five years or both.
(2) Where a person or corporate body previously convicted of an offence under subsection (1), commits an. offence under that subsection, the person or corporate body is, on conviction liable for the second or subsequent offence to a fine of at least #1,000,000 of imprisonment for a tern of five years.
