Section 32 Electricity Act 2023

Section 32 of the Electricity Act 2023 is about Protection of land belonging to the ISO. It is under Part IV (Incorporation and Licensing of ISO) of the Act.

(1) Subject to the provision of the Land Use Act, land vested in the ISO shall not be liable to be acquired compulsorily under any enactment or law, and notwithstanding anything in other enactment or law, no mining operations or any other activities whatsoever shall be carried on, in or under any land vested in the ISO or any land over which the ISO is entitled to rights of way or support for the benefit of lands so vested, except with the prior consent in writing of the Minister.

(2) For the purpose of this section, “land” includes any land under water beyond the territorial waters of Nigeria to which Nigeria is for the time being entitled to any exclusive rights.
