Section 40 Federal Competition and Consumer Protection Act 2018

Section 40 of the Federal Competition and Consumer Protection Act 2018 is about Composition of the Tribunal. It is under Part VII (The Competition and Consumer Protection Tribunal) of the Act.

(1) The Tribunal shall consist of-
(a) a chairman, who shall be a legal practitioner with 10 years post call and cognate experience in the field of competition, consumer protection or commercial and industrial law ;and

(b) six other members, with at least 10 years professional experience in any one or more of the following educational fields-
(i) competition and consumer protection law,

(ii) commerce and industry,
(iii) public affairs,
(iv) economics,

(v) finance, or
(vi) business administration or management.

(2) The Chairman and other members of the Tribunal shall be appointed by the President subject to confirmation by the Senate.
