Section 9 Federal Competition and Consumer Protection Act 2018

Section 9 of the Federal Competition and Consumer Protection Act 2018 is about Emoluments of Members of the Commission. It is under Part II (Establishment of the Federal Competition an Consumer Protection Commission) of the Act.

(1) There is a vacancy in the Board if a Commissioner –
(a) dies;
(b) is removed from office in accordance with this Act;

(c) resigns from office; or
(d) upon the completion of his tenure of office.

(2) A vacancy in the Board shall be filled by the appointment of another person to the vacant office by the President in accordance with this Act, as soon as is reasonably practicable after the occurrence of such vacancy.

(3) In the instance of a vacancy on the Board that is created consequence upon death, removal or resignation of a Commissioner, any person so appointed shall hold office for the unexpired term of office of his predecessor. I

(4) The provisions of subsection (3) shall not apply to the filling of vacancies in respect of Executive Commissioners whenever it is created.
