Section 225A of the 1999 Constitution of Nigeria

Section 225A of the Constitution of Nigeria 1999 is about De-registration of political party. It is under Chapter VI (The Executive) of the Act.

The Independent National Electoral Commission shall have power to de-register a political party for-
(a) breach of any of the requirements for registration;

(b) failure to win at least twenty-five percent of votes cast in-
(i) one State of the Federation in a Presidential election, or
(ii) one Local Government of the State in a Governorship election.

(c) failure to win at least-
(i) one ward in the Chairmanship election,
(ii) one seat in the National or State House of Assembly election, or
(iii) one seat in the Councillorship election.

    The rule of law have to take it course when matters of constitution is to be implemented so I personally one to advise the affected political party like ADC, ZLP, Accord party, AAP and to just accept the ruling with good faith because this is a constitutional matter it is not a political matter so the court has explained the law in 2020 5 political party was also the registered from inec porter for failing to meet up with 25% of total votes in the state and the local government and in a world so this are the sin of this five political party that INEC will be deregistered according to the court ruling.

      Then the court may have lost sense of complete constitution interpretation as regards to ADC party deregistration.
      The constitution outlines the ingredients of party deregistration with – or conjunction which means if any political party could meet up any of the required constraints, it holds all tendencies to remain registered.
      ADC, won some house of representatives and assembly seats in the last 2023 general elections, hence ADC beats up party deregistration failure according to Section 225A of 1999 constitution as amended.
