Section 35 Conveyancing and Law of Property Act 1881

Section 35 of the Conveyancing Act 1881 is about Power for trustees for sale to sell by auction, &c. It provides as follows:

(1.) Where a trust for sale or a power of sale of property is vested in trustees, they may sell or concur with any other person in selling all or any part of the property, either subject to prior charges or not, and either together or in lots, by public auction or by private contract, subject to any such conditions respecting title or evidence of title, or other matter, as the trustees think fit, with power to vary any contract for sale, and to buy in at any auction, or to rescind any contract for sale, and to re-sell, without being answerable for any loss.

(2.) This section a plies only if and as far as a contrary intention is not expressed in the instrument creating the trust or power, and shall have effect subject to the terms of that instrument and to the provisions therein contained.

(3.) This section applies only to a trust or power created by an instrument coming into operation after the commencement of this Act.

    I and my sibling are not in good terms over our inheritance. The conveyancer/agent who help us with selling our inheritance is taking sides because he’s related to us and I’m not suppose to enquire about the progress. He recently emailed the guy from the Master of the high court and copied me that he has advertised the property under s35 of the act. Please explain this for me.
