Section 37 Tenancy Law of Lagos State 2011

Section 37 of the Tenancy Law of Lagos State 2011 is about Unreasonable increase of Rent. It provides as follows:

(1) Subject to any agreement to the contrary, an existing tenant may apply as in form TL 11 to the Court for an Order declaring that the increase in rent payable under a tenancy agreement is unreasonable.

(2) In determining whether an increase in the rent is unreasonable, the Court shall issue hearing notice as in form TL 12 to the Landlord and shall consider the application on the following grounds –
(a) the general level of rents in the locality or a similar locality for comparative analysis;

(b) evidence of witnesses of the parties ;and
(c) any special circumstances relating to the premises in question or any other relevant matter.

(3) If satisfied that the increase in the rent is unreasonable, the Court may order as in form TL13 that the increase in the rent be changed to a specific amount.

(4) Notwithstanding the provisions of any Law, it shall be unlawful for a landlord to eject a tenant from any premises pending the determination of the action.

    good morning sir am mr Godstime okonigene.from Edo state.i just move to a house which i paid agent and agreement 25600 naira on 5th of April 2025 just A room and parlor normal not seif containe.then i move in 1st week of may 2025.now my rent we expire next month.then i çall my lar lord that i want to pay my rent what he told me is that he has increase the rent.am just completing a year.where is one happing.

    The normal rent is 144000 naira.pay a year that means 6000 naira pay a room now the lar lord just woke up and said he want to increase it to 168000 naira when am just completing one year.is very unfil now.
