Section 39 NDLEA Act

Section 39 of the National Drug Law Enforcement Agency Act 1989 is about Offences in relation to forfeiture orders. It provides as follows:

(1) Any person, who without due authorisation by the Agency, deals with, sells or
otherwise disposes of any property or asset which is the subject of an attachment, interim order or final order shall be guilty of an offence and liable on conviction to imprisonment for a term of five years without the option of a tine.

(2) Any manager or person in control of the head office or branch of a bank who fails to pay over to the Agency upon the production to him of a final order shall be guilty of an offence under this Act and shall be liable on conviction to imprisonment for a term of not less than one year and not more than three years, without the option of a tine.
